ENKNEAUXN Duty of Care

ENKNEAUXN is a qualified practitioner-run entity working across several sectors (including but not limited to live music, education, wellbeing and community work).

Upholding a commitment to centring duty of care principles whilst acting as a professional. This means taking reasonable steps to actively enable and sustain safer and braver spaces, projects and collaborations ENKNEAUXN hosts, supports, attends or aligns with.

ENKNEAUXN Commitments

To mobilise development and curate environments in efforts to contribute to positive experiences in life.

To apply trauma-informed and risk-aware practice, recognising that lived experience, identity and environment shape wellbeing and actualisation.

To recognise that no one is perfect. Safeguarding is an ongoing practice of accountability, learning, adaptation, holistic and restorative practice.

To apply contextual safeguarding practices, acknowledging that risk and harm can occur in the home, amongst peer groups, online, academic, cultural spaces and wider environments.

What Safeguarding Means Here

Safeguarding includes, within means and remit, preventing and responding to:

• (Sexual) harassment, illegal violence or exploitation.
• Bullying, intimidation or hate-based harm.
• Risks to health, safety or wellbeing.

• In person and online spaces facilitated by or in collaboration with ENKNEAUXN

Who ENKNEAUXN Will Avoid Aligning With

ENKNEAUXN maintains awareness of harmful people that are (un)known to publicly / privately cause intentional harm and abuse. ENKNEAUXN acknowledges the risk and danger perpetrators and their enablers / apologists can cause to individuals, community and culture.

Out of respect for those harmed and impacted, ENKNEAUXN may misalign and/or refuse to work for / with / around those harmful people. This may also include those who align, associate, are mutuals or connect with these harmful persons. Although this is a complex feat, attempts will be made to honour this as much as possible and to proceed accordingly where circumvented. ENKNEAUXN is committed to spaces and people that protect the purpose and people that actively contribute to it.

Roles and Responsibilities

A Lead Safeguarding Practitioner (LSP) will be appointed ahead of each project or event to hold overall responsibility.

An On-Shift / Project Lead will act as lead point of contact to report concerns to during activities.

All staff, volunteers and participants share responsibility to uphold boundaries and report concerns appropriately.

Raising Concerns

Emergency: Call 999 (urgent) or 101 (non-urgent) or appropriate specialist services if someone is at significant or immediate risk.

In person (tell someone, tell multiple different people): Appointed Safeguarding Lead, Onsite / Online Lead / Workers / Parent / Guardian / Security / Police / Friends / Attendees / Venue or Business Owners / People walking by. Enable (multiple) active witnesses and bystanders.

Accessibility

ENKNEAUXN aims to make all policies and reporting routes accessible. ENKNEAUXN will consider, log and assess concerns raised through any communication method. Please feel free to make contact with better or different ways to make this more inclusive.

What Happens After a Report

ENKNEAUXN aims to acknowledge all reports and disclosures as soon as possible.

• Reports are to be handled as confidentially and respectfully as possible.
• Information to be shared upon request, when necessary to protect safety or where legally required.
• You decide whether authorities or external agencies are contacted, unless there is immediate risk of, or active, harm, or circumstances mean that ENKNEAUXN must act accordingly.

Privacy and Data

ENKNEAUXN requires the minimum information needed. Reports, concerns and incidences are to be logged. As well as ENKNEAUXN’s rights to retain, you have rights to request to access, correct or delete data stored. Please read the Privacy Policy in full.

Support Available

ENKNEAUXN may offer short-term one-to-one wellbeing support where appropriate.

ENKNEAUXN may signpost or refer you to external services for the appropriate and specialist care, advice or support. ENKNEAUXN can source and share training opportunities and resources.

This policy is based on the legal and regulatory framework for duty of care and safeguarding in the United Kingdom, including but not limited to:

Children Act 1989 and 2004, Working Together to Safeguard Children 2018, Keeping Children Safe in Education 2023, Safeguarding Vulnerable Groups Act 2006, Protection of Freedoms Act 2012, Equality Act 2010, Human Rights Act 1998, Care Act 2014, The General Data Protection Regulation and Data Protection Act 2018, The Prevent Duty (Counter-Terrorism and Security Act 2015), Sexual Offences Act 2003, Public Interest Disclosure Act 1998, The Worker Protection (Amendment of Equality Act 2010) Act 2023 (including the new preventative duty on harassment from 26 Oct 2024), NSPCC, Equality and Human Rights Commission and relevant local authority safeguarding boards.
